Amendment to Repeal Income Taxes

Currently the U.S. Government is authorized to levy taxes on any person's income.  Any person includes individual citizens, businesses, corporations and other identities.  This is authorized by the 16th Amendment to the US Constitution which states:


The congress shall have the power to lay and collect taxes on incomes, from whatever source derived, without appointment among the several states, and without regard to any census or enumeration.

The 16th Amendment was ratified on February 3, 1913.



The Constitution in Article I (the Legislative Branch), Section 8 (Powers Granted to Congress), paragraph 1 states:


The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;



As can be seen from above, Congress has always had the authority to collect taxes by means other than INCOME TAX. It is our intention to move our Nation back to other methods of collecting taxes.

There is a debate/conservation going forward that some say the Supreme Court has ruled on the definition of INCOME; "Income may be defined as the GAIN derived from capital, from labor, or from both combined."(Stratton's Independence v. Howbert, 231 U.S. 399, 415:) That side of the debate also states that the Supreme Court concluded that an income tax on wages is not an income tax, but a tax on gross receipts, taxing both income and capital, and, therefore, unconstitutional.

The other side of the debate states that all this is taken out of content and wage income is a gain where the property value of the labor is zero thus yielding a gain:

Gain = Price - Cost

The contention is that the COST of our labor is zero.

Gain = Wages - $0
therefore: Income = Wages and is all GAIN

We do not try to resolve this dispute between the two sides. We believe that the only solution is to repeal the 16th Amendment and remove this debate from the conservation.

So it is up to "We the People" to effect this change to amend the Constitution to remove the 16th Amendment. Congress can then determine the method of taxing that the public desires.


AMENDMENT
[1]The sixteenth article of amendment to the Constitution of the United States is hereby repealed.
[2]This article shall be inoperative until January 1 of the year following or of the next year following ratification but not less than six months shall pass between ratification and implementation.
[3]This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by convention in the several States, as provided in the Constitution, within seven years from the date of submission hereof to the States by the Congress.
