On February 28, 2008, the California State 2nd District Court of Appeals ruled that parents do not have a right to home school their children unless they have teaching credentials.
Taking from the Los Angeles times: "Parents do not have a constitutional right to home school their children," wrote Justice H. Walter Croskey in a Feb. 28 opinion signed by the two other members of the district court. "Parents who fail to [comply with school enrollment laws] may be subject to a criminal complaint against them, found guilty of an infraction, and subject to imposition of fines or an order to complete a parent education and counseling program."
Recently, May 2013, a federal court has ruled that the "Right to Home-School" your children is NOT a Liberty based on the United States Constitution. Thus this reinforces the earlier ruling that "Parents do not have a constitutional right to home school their children" as noted above. This was a ruling from the case governing the family who asked for asylum from Germany where they did not have a right to home-school their children. If this is allow to stand, no citizen will have the right to home-school their children. This could lead to the forced government schooling of all children: A Progressive's dream!
The following amendment to the U.S Constitution is an effort to remedy this situation. This will allow parents to select public, private or home schooling for their children. This does not prohibit the states to regulate education via minimum teaching materials and testing requirements.

[1] | The rights of citizens to select the type of schooling for their children including the right to home school and teach their children shall not be denied. |
[2] | This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by convention in the several States, as provided in the Constitution, within seven years from the date of submission hereof to the States by the Congress. |
